PRIVACY POLICY

Overview

LOOKCAST S.R.L and LOOKCAST L.L.C. ("LOOKCAST") commit to protect user privacy. This privacy policy ("Privacy Policy") applies to the web sites https://lookcastapp.com and https://lookcast.cloud, which is owned and managed by LOOKCAST. According with applicable privacy law, the Privacy Policy describes how LOOKCAST and LOOKCAST Companies collect and use the data through the sites, what data are collected, with whom data are shared, what measures are applied to keep data secure, what are user's privacy rights and how user can enforce them. This Privacy Policy does not apply to any data that LOOKCAST and LOOKCAST Companies collect offline or through sources other than the sites.

Who owns and manages your personal data

LOOKCAST, registered office in via Silvio Pellico 28/1, Pescara - Italy, [email protected] is the data controller for the processing of personal data for managing the sites and for marketing and profiling purposes, in accordance with the applicable law.

The data Processor of LOOKCAST for these purposes is the then current CRM Manager, available at the address of the Controller, as indicated above.

The nature and kind of data processed

If user visits the sites usually we collect only the so named surfing data, which are data necessary to the technical functioning of the sites and Internet communications protocols. Surfing data are for example: the computer's IP addresses or domain names used to visit the sites together with other parameters on the relevant operating system. LOOKCAST collects also data such as the number of visits and the time spent on the sites for statistical purposes, to allow proper functioning of the sites and to improve its functionalities. By their nature, surfing data may allow the identification of user by association with other information owned by third parties; LOOKCAST does not collect surfing data to identify users. Surfing data are deleted immediately after they are made anonymous; LOOKCAST may use said data to assess possible responsibilities for information crimes against the sites or realized through the sites. With this exception, LOOKCAST keeps surfing data only temporarily and according to applicable legislation.

LOOKCAST collects and uses personal data voluntarily provided by user upon interaction with the sites functionalities and request of the services offered by the sites, for example when user subscribes to the sites, to our newsletter, uses the Intercom chat Service (as long as it is made available), purchases products, takes part in initiatives realized through the sites, requests information or sends us communications. As permitted by applicable privacy law, LOOKCAST may also process user's personal data obtained from third parties in the course of its business activity. With the user's consent, LOOKCAST may further process user's personal data for survey and market research purposes, for profiling purposes, for marketing and promotional purposes. For more information on the processing purposes please refer to the below section "Purposes and conditions of the personal data processing." We may collect the following information: name, sex, place and date of birth, nationality, identification codes such as Tax/fiscal code, contact details such as street address, telephone number, e-mail and further information of an optional nature. When personal data are collected on the sites, we display a specific privacy policy and we ask for user's consent, according to applicable privacy law. If user provides us with personal data of third parties (for example in case of use of the functionality 'share' that allows user to send information on the sites and our products and initiatives to friends trough social medias) user shall provide that said communication and our following use of data for relevant purposes comply with applicable privacy law, so for example user may provide third parties' data only after having duly informed them and with their consent, if legally necessary.

Place where personal data are stored

Personal data will be stored and processed through an electronic system owned and managed by LOOKCAST or by third parties providing technical services to LOOKCAST; for more details please see the below section "Extent of personal data communication and transfer abroad". Data will be processed only by specifically authorized staff, including staff in charge of performing non-routine maintenance operations.

Cookies

Cookies are small data files stored on the hard disk of the user's computer. The sites deploys cookies and for further information on cookies and on how to disable cookies, we encourage to read our Cookie Policy. The sites may contain links to other sites. We do not have any access or control of cookies, web beacons and other tracking technologies used on third parties' web sites that user may access from the sites, of the availability and of any content or material contained in, or obtained through, any such sites, and of the relevant conditions of data processing, and hereby we expressly disclaim any relevant liability. User should verify the privacy policy of third parties' web sites accessed from the sites to be informed of the data processing conditions, since this Privacy Policy only applies to the sites.

Purposes and conditions of the personal data processing

In addition to data collected passively, we collect and use data that user actively provides to the sites when interacting with the sites, its functionalities and services. LOOKCAST will process user's personal data for the following purposes: managing the subscription to the sites, newsletter or mailing list, managing the user's participation in promotions and other initiatives organized through the sites, to reply to and to manage user's request for information, questions, communication or feedback to LOOKCAST. User's personal data will also be processed by LOOKCAST and LOOKCAST Companies to comply with obligations imposed by laws, regulations and Community legislation and to establish or defend a legal claim of LOOKCAST and LOOKCAST Companies.

For sales activities, LOOKCAST use personal data to manage purchases through the sites (which includes all activities pertaining to the sale and after-sale services, such as for example fraud prevention, managing of returning items, guarantee, customer support, interaction with our customer service)

With the user's consent, LOOKCAST may also process user's personal data, which may include information on preferences, habits, lifestyle, details of purchase, for marketing operations, commercial or advertising communications, direct sale, market surveys, sale support through e-mail, telephone, sms, mms, chat, social network and traditional mail, including possible invitations to LOOKCAST events. With user's consent, LOOKCAST may define individual and group profiles (profiling purposes) and may send personalized communications. User may always specify the preferred means of contact and opt out of receiving promotional communications through one or all of the communication channels listed above. Consent for marketing and profiling purposes is optional and without consequence if user denies consent.

With the user's consent, purchase data will be stored for marketing and profiling purposes for a period of 36 months, as per the authorization of the Italian privacy authority (Garante per la protezione dei dati personali) obtained by LOOKCAST on March 9, 2017, unless local laws require otherwise. Upon expiry of this period, or upon withdrawal of your consent, purchase data will be automatically deleted or made anonymous in a permanent and non-reversible way.

Security of personal data

LOOKCAST and LOOKCAST Companies are committed to protect the security of user's personal data and comply with security provisions set forth by applicable laws and regulations to prevent loss of data, unlawful or unfair use of data and unauthorized access to data. LOOKCAST and LOOKCAST Companies use a variety of advanced security technologies and procedures to help protect user's personal data. For example, personal data are stored on secured servers placed in controlled locations. Moreover, for the transmission of some data through the Internet, updated encryption techniques are employed. User may help to update and keep accurate its personal data by notifying LOOKCAST and LOOKCAST Companies of any amendment relating to user's address, title, telephone number or e-mail address. User may make these changes on-line following the instructions reported on relevant user's profile pages.

Extent of personal data communication and transfer abroad

User's personal data will be shared according to this Privacy Policy and the privacy policies published on the sites where data are collected. User personal data will be accessible on a need-to-know basis by authorized personnel and by the Processor of LOOKCAST above mentioned. The updated list of Processors and of the subjects to which data may be communicated remains at user disposal free of charge upon request to LOOKCAST and its Processor as well as to LOOKCAST Companies (for sale related activities).

Personal data are shared with public entities, banks, third parties involved in corporate transactions and extraordinary operations. Furthermore, personal data are shared with consultants, professional and technical service providers under data processing agreements. Third parties only receive the information necessary to carry out the relevant activities. Other companies directly or indirectly controlled by LOOKCAST, LOOKCAST companies in joint venture arrangements and LOOKCAST franchisees, acting as external data processors may access personal data for profiling, marketing and customer relationship management purposes (to ensure the same customer benefits worldwide). Personal data are not disclosed to unidentified recipients; they may be accessed by shop personnel worldwide for purposes of sale support. User's personal data may further be communicated to legitimate addressees under applicable laws, thus for example in case of judicial processes, request by competent courts and authorities or other legal obligation, and if LOOKCAST and LOOKCAST Companies in good faith holds the data communication as necessary to comply with obligations deriving from applicable legislation, to protect and defend the rights and property of LOOKCAST, LOOKCAST Companies and the sites. Some of the data recipients may be located in third countries that do not provide an adequate level of data protection as defined within the EEA. User's personal data will be transferred outside the EEA with the precautions required under applicable privacy law to guarantee data protection, security and confidentiality.

Providing of personal data

Providing personal data is necessary to allow LOOKCAST and LOOKCAST Companies to comply with applicable legislation and for performance of the services and functionalities offered by the sites and required by user, such as subscription to the sites, managing of products' purchase (which includes all activities functional to the sale and after-sale services, such as for example fraud prevention, managing of returning items, guarantee, customer support, interaction with the customer service) and of promotions and other initiatives realized through the sites, replying to and managing of request of information, questions, communication or feedback. Denial by user to provide personal data in the above referenced circumstances would make it impossible for user to receive the requested services, products or information as above specified. Providing of data to LOOKCAST for survey and market research purposes, for profiling purposes, for marketing and promotional purposes as specified in the above section "Purposes and conditions of the personal data processing" is optional; denial by user will have no consequences on providing the requested services, products or information requested.

User's rights

User is entitled at any moment to enforce the privacy rights under applicable law, including for example to obtain confirmation that user's personal data exist or not, verify content, accuracy, ask for integration, updating, amendment, deletion, block for breach of laws, oppose the processing for legitimate reasons.

For the updated list of the data processors of LOOKCAST and of data recipients, for further information on the data processing and to enforce privacy rights, user may contact at any time LOOKCAST or its data processors as well as the LOOKCAST Companies (for purchase activities) as mentioned above. The Privacy Policy is subject to updating and amendment. The version published on the sites is the version currently in force. Changes to the Privacy Policy will be communicated by placing a notice on the sites that reads "Newly Revised Privacy Policy" or the like. LOOKCAST invites user to periodically review the Privacy Policy to be informed of any relevant change.

LOOKCAST and the LOOKCAST Companies in charge of online purchases outside Europe (please see below) as data controllers, inform you of the following:

Data collection and purposes of processing.

We collect personal data from you at online registration and afterwards in the course of our activities, including online and including details of your purchases for the following purposes: to comply with laws, enforce rights and provide after-sale services, if you require these services to us (including fraud prevention, returns, guarantee, and customer support). Online activities include managing your interaction with LOOKCAST websites (subscription to websites and online initiatives like newsletters, mailing lists and promotions) and delivery of requested information/material; see LOOKCAST Privacy Policy at www.lookcast.com. Providing data for these purposes is necessary; if you do not provide data it would not be possible to provide the products or services that you request. Data may be used to update and correct the information previously collected on you.

Additional data processing purposes.

With your consent, which is optional, LOOKCAST, at points of sale and by paper and/or electronic forms or online may collect information on your preferences, habits, lifestyle.

These data together with details of your purchases, with your consent, are used for marketing operations, commercial or advertising communications, direct sale, market surveys, sales support in shops worldwide through e-mail, telephone, sms, mms, chat, social network and traditional mail, including possible invitations to LOOKCAST events.

With your consent, data are also used to define individual and group profiles (profiling purposes) and to send you personalized communications. You may always specify your preferred means of contact and you may always opt out of receiving promotional communications through one or all of the communication channels listed above. Consent for marketing and profiling purposes above specified is optional and if you deny consent, this will have no consequences.

Only with your consent data relating to your purchases will be stored by us for marketing and profiling purposes for a period of 36 months. Upon expiry of this period, personal data will be automatically deleted or made anonymous in a permanent and non-reversible way.

Ways of data processing and data security.

We process data in paper and electronic form in line with security requirements defined by applicable laws; our data processors below specified and our authorized personnel (for example personnel of CRM, IT, Retail Departments) can access data on a need-to-know basis.

Furthermore, we transfer personal data to consultants, professional and technical service providers related to the purposes mentioned above as our data processors. Third parties only receive the information necessary to carry out the relevant activities. Other companies directly or indirectly controlled by LOOKCAST, LOOKCAST Companies in joint venture arrangements and LOOKCAST franchisees, as processors of LOOKCAST, may access personal data for profiling, marketing and customer relationship management purposes (to ensure the same customer benefits worldwide). Your personal data are not disclosed to unidentified recipients. We allow access to personal data by subjects located outside the European Union after taking the measures required by the applicable law.

If you consent to marketing activities, data may be consulted by shop personnel worldwide for purposes of sale support.

Privacy rights - Data controllers and processors - Information.

You may always enforce your privacy rights as provided for by applicable law, for example you may access the data, verify data content, origin, accuracy, you may ask that data be integrated, updated, amended, deleted, blocked for breach of law, you may object to processing for legitimate purposes - for example you may opt-out from marketing activities. The data processor of LOOKCAST for the purposes of this privacy notice is the then current CRM Manager, available at the data controller's offices. User provided information.

You might use LOOKCAST to distribute your own personal information, if you include it in the lookbook you publish.

You can remove any piece of personal information from your lookbooks directly from the LOOKCAST editor in the same way you entered it. Search engines may hold a copy of this information. While we ask them to reindex any public information you entered as it changes and we remove campaigns from the indexable pages as you delete them, search engines and other crawlers can still maintain a cached copy of your information.

In general, once it is made available publicly through a campaign, we can no longer control who crawls the data, so share your personal information with caution.
